This Terms of Service Agreement sets forth the legally binding terms for your use of the FX Made Simple™ online class instruction. You are only authorized to use the FX Made Simple™ online class instruction if you agree to abide by all the terms that are part of this Agreement. If you wish to become a member of FX Made Simple™ and make use of the FX Made Simple™ online class instruction, you must read this Terms of Service Agreement in its entirety and indicate your acceptance during the registration process.

  1. Proof of purchase is required for membership. Any unauthorized accounts will be terminated.
  2. You agree not to make any claims regarding earnings, unless you have proof for such claims.
  3. This service is provided on an As Is, As Available Basis. We make NO guarantees of any kind, either expressed and/or implied.
    1. It is against FX Made Simple policy to use the FX Made Simple™ name and/or logo in your advertisements without the prior written consent and approval from the FX Made Simple. Anyone using the FX Made Simple™ name and/or logo, without obtaining the prior written consent and approval from the FX Made Simple, is subject to the immediate suspension of their FX Made Simple™ website without warning.
    2. Anyone using the FX Made Simple™ name in any type of promotional material, must be in full compliance with our Terms of Service, which govern the rules and policies governing the marketing methods of FX Made Simple™.
    3. Anyone using the name FX Made Simple™ in any marketing materials, such as emails, websites, flyers, articles, press releases, videos, etc., must display the following disclaimer at the bottom of every page of their marketing material. The size and color of the word “DISCLAIMER” should be large enough and of a contrasting color so it may be easily seen. The entire disclaimer must be displayed in caps and boldface font (e.g. Arial), with a minimum size of 10 points, as shown below : DISCLAIMER – “THIS WEBSITE WAS DESIGNED AND IS MAINTAINED BY AN INDEPENDENT MEMBER OF FX MADE SIMPLE™. FX MADE SIMPLE™ IS NOT RESPONSIBLE FOR ANY OF ITS CONTENT AND THEREFORE WILL NOT BE HELD LIABLE. THE OWNER OF WEBSITE IS THE ONLY ONE LIABLE FOR ANY AND ALL OF ITS CONTENT’. (Note: The word website must be replaced with the words email, flyer, article, press release, video, etc., depending on the type of marketing material being used.)
    4. FX Made Simple™ reserves the right to suspend and/or terminate any Member’s website that is not in compliance with our Terms of Service, or if false or misleading statements referencing FX Made Simple™ are being made or if the Member is competing with FX Made Simple™ in any way.
    5. Any FX Made Simple™ Member’s website that uses any Domain Name similar to, or with a close resemblance to, the FX Made Simple™ Domain Name, will be suspended until it becomes compliant.
    6. You joined FX Made Simple™ as a Member, and as such you ONLY represent yourself. You do NOT represent FX Made Simple™. We have a ZERO TOLERANCE POLICY on this issue.
  4. Under no circumstances, including negligence, shall we, or anyone involved in creating, producing or distributing this online class instruction, be liable for:
    1. any direct, indirect, incidental, special or consequential damages that result from the use of, or inability to use this information;
    2. all the files and software contained within it, including, but not limited to, reliance on any information obtained through this service; or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation, or transmission;
    3. any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction and/or unauthorized access to our records, programs or services.
  5. We reserve the right to add or delete material to your FX Made Simple™ website and/or make any changes to the service and/or this agreement without notice.
  6. We may terminate, at our sole discretion and without notice, any membership deemed to be in breach of this agreement, anyone found abusing or misusing the service, and/or anyone harassing other members or the administrative staff in any way.
  7. In the unlikely event that this program should ever terminate its operations, it’s creator, operators, members, assigns and successors shall not be held liable for any loss whatsoever to our Members. Materials, tools and resources, and other services are made available to the new FX Made Simple™ member immediately after sign-up and they shall be deemed as services for their payment.
  8. Individuals and/or sites involved with the following activities are NOT ELIGIBLE: selling, providing or linking to unlicensed content, pornography, warez, pirated software, hacking or spamming software, email address lists or harvesting software, or any materials endorsing violence, hatred, revenge, racism, victimization, or criminal activity.
  9. FX Made Simple™ does not make any claims on how much money you can earn with our program.
  10. You agree to accept emails and phone updates regarding FX Made Simple™. We will never inundate you with emails, spam or phone calls.
  11. Advertising FX Made Simple™ at an amount less than the $600 cost listed on the FX Made Simple™ website is NOT allowed and your FX Made Simple™ website will be suspended without notice.
  12. Your relationship with FX Made Simple™ is not that of an employee or a partner relationship. You are a Member, therefore responsible for your own taxes, fillings, bookkeeping, etc.
  13. Please note that all sales are final and there are no refunds allowed.
  14. You shall use your best efforts to preserve and protect the integrity of the Content and You shall forthwith notify FX Made Simple of any infringement, whether actual, apparent, real or perceived, whenever occurring or determined, of such Content and render all reasonable assistance to FX Made Simple in the enforcement of it rights and particularly upon request.
  15. FX Made Simple Non-Compete Policy:
    1. For good and valuable consideration the receipt of which is hereby acknowledged, the Member hereby agrees not to directly or indirectly compete with the business of FX Made Simple and its successors and assigns during the period of membership and for a period of (2) two years following termination of membership and notwithstanding the cause or reason for termination.
    2. Member shall not own, manage, operate, consult or to be employed in a business substantially similar to, or competitive with, the present business of FX Made Simple or such other business activity in which FX Made Simple may substantially engage during the term of membership.
    3. Member acknowledges that FX Made Simple may, in reliance of this agreement, provide Member access to trade secrets, customers and other confidential data and good will. Member agrees to retain said information as confidential and not to use said information on his or her own behalf or disclose same to any third party.
    4. This non-compete agreement shall be in full force and effect for (2) two years, commencing with the date of membership termination.
    5. This agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns, and personal representatives.
